YOUR
"GEMS" MARRIAGE - The legal process in
Scotland
(General
outline guidance)
You
must submit a "marriage notice" the Registrar
of Births Deaths and Marriages At least 15 days before
( and at the most 3 months before ) the wedding date,.
If either bride or groom has been married before,
you must submit this notice to the registrar at least
6 week prior to the wedding date." Marriage notice
forms may be obtained from the registrar - address
& tel. no below.
You
must enclose the following with the Marriage
Notice Form ***:

or widowers must include the death certificate
of the deceased spouse |

A
certificate issued by a competent authority
of the country of residence (usually the civil
authority) if either party is a national of
a country other than the UK, to indicate that
there is no impediment to the proposed marriage

A
certified English translation of any certificate
not in the English language. |
The
Registrar will check all documentation to ensure
that the parties are free to marry.
The
Registrar can then prepare your Marriage Schedule.
The process normally takes 14 days.
Religious
Ceremony: You must collect the Marriage Schedule
from the registrar’s office, in person, no
more than 7 days prior to the wedding. The person
who " marries" you at your religious ceremony,
can not do so without the Marriage Schedule.
He or she must sign the schedule. Two witnesses
(16 years or older) signatures are also required.
Civil
Ceremony: If the marriage is to be held at the
Registrar’s office, the registrar will retain
the Marriage Schedule.
The
Completed Marriage Schedule must be returned to
the Registrar within 3 days.
Footnote:
***When
one of the parties is resident in England or Wales
and the other in Scotland, the former may apply
to the English or Welsh Superintendent Registrar
for a certificate. The Scots Registrar will accept
this certificate in lieu of notice.
